The terms and conditions of this agreement shall be as follows:
1. Sales Price:
Buyer shall pay a non refundable deposit of $100.00 that will be included in the total price
of the Dog. Total purchase price is ______________ unless the Buyer/s fails to comply with
the terms of the Spay/Neuter provison in Paragraph 3. Should the Buyer/s fail to comply
with the terms of Paragraph 3, then the total price of the Dog shall be Two Thousand Five Hundred Dollars ($2,500.00).
2. Health:
Breeder certifies that the Dog is in good health. Buyer/s shall have the dog examined by a veterinarian within 72 hours, and if the veterinarian determines the Dog is not in good
health the Buyer/s shall return the Dog within one week of the date of purchase.
3. AKC Registration:
AKC registration papers shall be held with the Breeder until the Dog is spayed or neutered before 8 months of age. Proof of spaying or neutering, signed by performing Veterinarian
will be forwarded to the breeder one week after procedure. Buyer/s understands and agrees that if spay/neuter provision is not complied with, the price of the Dog becomes Two Thousand Five Hundred Dollars ($2,500.00) and the Buyer/s shall pay the Breeder the balance of money owed. This Dog will be on a LIMITED AKC registration. AKC registration papers shall be given or transferred to the Buyer, after proof of spaying or neutering.
4. Maintenance, Care and Liability:
The Buyer/s agrees to maintain said Dog in good health. Buyer/s will be soley responsible
for any claims, lawsuits, fines or any other legal actions arising from said Dog's actions and agrees to hold the Breeder completely harmless in the event of any claim, lawsuit or legal
action arising from the actions of said Dog. The Dog is considered to be a family companion
and thus a house Dog that will not be left outside in inclement weather. Buyer/s agrees that
this Dog will not be chained for more than 24 continuous hours in any seven-(7) day period,
or trained or used as an attack Dog. The Buyer/s shall never abandon this Dog to an Animal Shelter nor sell it to a Research Center. Buyers/s understands that violation of these terms
will cause physical and emotional harm to this Dog.
5. Harm to Breeder and Liquidated Damages:
Buyer/s agrees to and fully understands that any violation of the provisions of this Agreement could and will cause substantial harm to the Breeders professional standing with various dog breeder and fancier organizations and/or harm to the Dog. Buyer/s agrees that any and all violations of the provisons of the Agreement shall result in reimbursement to the Breeder of Liquidated damages not to exceed Twenty Five Hundred Dollars($2,500.0). Buyer/s acknowledges, understands and agreed that these liquidated damages are not a penalty, but are intended as reimbursement for damage to the professional reputation of the Breeder and or harm to the Dog.
6. Reversion of Ownership:
Should the Buyer/s be unable to keep Dog as stated in this Agreement for any reason or at anytime. Dog will be returned to the breeder with AKC registration papers signed over, with
no monetary reimbursement at the time. If dog is placed in a new home any money received from new owners, minus what ever expenses Breeder has incurred to board and care for the Dog, will be forwarded to the Buyer. If the Dog is older than 1 year of age there will be no refund back to Buyer/s.
7. Agreement:
It is understood and agreed that Buyer/s by signing this form, has read and understands the provisons of the Agreement, and agrees to perform its terms beginning on the day and date written below. This Agreement shall not be in effect until signatures of Buyer/s and Breeder
are affixed.
8. Enforcement:
Buyer/s and Breeder agree that terms of this Agreement shall be enforced under the provisons of Nevada Law and Statutes, or the provisons of the Law and Statues of the State of current residence of the Breeder. Buyer/s and Breeder agree that the Buyer/s shall pay any and all legal fees, attorney fees, court fees, travel costs, or any other costs associated with enforcement of the terms of this Agreement.
